Notwithstanding anything to the contrary in this chapter, the community development
director may, in his or her sole discretion, issue BUAs in the second and/or third
releases in excess of the numbers set forth in sections 26-2-20 and 26-2-30, and in excess of the two thousand five hundred seventy-nine BUAs contemplated
by this chapter, to the extent that there exist parcels which have been zoned to accommodate
more units than would otherwise be available under the BUA limits in sections 26-2-20 and 26-2-30. The owner of any parcel(s) wishing to receive an increased BUA allocation
shall submit a request for an increased allocation to the community development director
prior to the issuance of a final map for the parcel(s). No such request shall be approved
until it has been reviewed and found to be consistent with General Plan Policy 1.A.7
and/or any other general plan policy regarding growth caps, as well as with any growth-related
provisions in an applicable specific plan.
