§ 5B.3. Application to offer remote caller bingo

  • (a) Prior to providing remote caller bingo, organizations shall obtain a remote caller authorization from the city's community development director. The director shall grant such approval provided he or she determines that the organization's remote caller bingo games will comply with the terms of Chapter 5A, this Chapter 5B and all applicable state laws and regulations.

    (b) An organization wishing to provide remote caller bingo shall submit an application therefor in a form prescribed by the city development director or his or her designee. Each application shall be accompanied by a nonrefundable filing fee in an amount determined by resolution of the city council, if such a fee has been established. No fee shall be imposed if a request for a remote caller authorization is made concurrently with an application for a bingo license pursuant to Chapter 5A. However, in all cases, the following documentation shall be attached to the application, as applicable:

    (1) A certificate issued by the Franchise Tax Board certifying that the applicant is exempt from the payment of the taxes imposed under the Corporation Tax Law pursuant to Section 23701a, 23701b, 23701d, 23701e, 23701f, 23701g, 23701k, 23701l, or 23701w of the Revenue and Taxation Code. The community development director may waive this requirement and instead verify the applicant's tax-exempt status through the Franchise Tax Board's website.

    (2) Other evidence as the community development director or his or her designee determines is necessary to verify that the applicant is a duly organized mobile home park association of a mobile home park situated in the city.

    (3) All information required to be submitted to the commission pursuant to Section 326.3(j)(4) of the California Penal Code, excepting a copy of this chapter.

    (4) A copy of the organization's bingo license issued pursuant to Chapter 5A unless the application for a remote caller authorization is made concurrently with an application for a bingo license.

    (c) In addition to the foregoing, the community development director may require organizations to submit any other relevant information to assist the director in determining whether or not to approve a request to conduct remote caller bingo games.
